Terms of Service — umay

These Terms of Service (“Terms”) govern your use of the umay mobile application (“umay”, “the app”, “we”, “us”) developed and operated by Arda Kaan Özcan, an individual developer based in Türkiye (“Turkey”) (“we”, “us”, “our”).
By downloading, installing, or using umay, you agree to these Terms. If you do not agree, do not use the app.
1. Who can use umay
- You must be at least 18 years old to use umay. If you are between 13 and 18, you may only use umay with the consent and supervision of a parent or legal guardian.
- umay is intended for personal, non-commercial use.
- You are responsible for the accuracy of information you enter into the app.
2. Your health and umay
umay is a self-tracking and education tool, not a medical device.
- umay does not diagnose, treat, cure, or prevent any disease or condition.
- umay does not replace the advice of a qualified healthcare professional.
- Always consult a qualified clinician for medical decisions, especially regarding fertility, contraception, pregnancy, or cycle-related symptoms.
- Do not use umay in a medical emergency. In an emergency in Turkey, call 112, or go to the nearest hospital.
3. Your data
Your privacy matters. Our handling of personal data is described in our Privacy Policy. By using umay, you also agree to the Privacy Policy.
Highlights:
- Your cycle, symptom, mood, and energy logs are stored on your device by default.
- We do not upload your health logs to our servers.
- Anonymous, aggregated analytics (via PostHog, hosted in the EU) are opt-in and disabled by default. You can change your choice in Settings → Privacy & Data at any time.
4. License
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use umay on devices you own or control, via the Apple App Store.
All rights not expressly granted are reserved by the developer.
5. Acceptable use
You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of umay, except as permitted by applicable law.
- Use umay to violate any law or third-party right.
- Upload malicious content, attempt to disrupt the app, or bypass security.
- Resell, sublicense, or commercially exploit umay.
6. Subscriptions and in-app purchases (umay Pro)
Some features may be offered as a paid subscription (“umay Pro”).
- Subscriptions are billed through your Apple ID account.
- Payment is charged to your Apple ID at confirmation of purchase.
- Subscriptions auto-renew unless auto-renew is turned off at least 24 hours before the end of the current period.
- You can manage and cancel subscriptions in Settings → Apple ID → Subscriptions.
- Unused portions of a free trial are forfeited when you purchase a subscription.
- Refund requests are handled by Apple, not by us.
7. Third-party services
umay uses the following third-party services:
- PostHog (EU host,
eu.i.posthog.com) — anonymous analytics, only if you opt in. - Apple App Store — distribution, billing, and refund handling.
- Apple Health (optional) — if you choose to connect it for data import/export.
These services have their own terms and privacy practices. We encourage you to review them.
8. Intellectual property
umay, its name, logo, design, and content are owned by Arda Kaan Özcan and protected by intellectual property laws (including the Turkish Intellectual and Artistic Works Law, No. 5846). You may not copy, modify, distribute, or create derivative works without our written permission, except as allowed by these Terms.
9. Termination
- You may stop using umay at any time by deleting the app.
- We may suspend or terminate access if you violate these Terms or misuse the app.
- Upon termination, these Terms cease to apply, but sections that by their nature should survive (e.g., intellectual property, disclaimers, limitations of liability) will survive.
10. Disclaimers
To the maximum extent permitted by law — including the Turkish Consumer Protection Law (No. 6502) where you qualify as a consumer — umay is provided “as is” and “as available”, without warranties of any kind, express or implied, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Warranties that umay will be uninterrupted, error-free, or secure.
- Warranties regarding the accuracy of any prediction, insight, or recommendation.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including consumer rights under Turkish law and data-subject rights under KVKK).
11. Limitation of liability
To the maximum extent permitted by law, in no event will Arda Kaan Özcan be liable for:
- Any indirect, incidental, special, consequential, or punitive damages.
- Any loss of data, profits, goodwill, or other intangible losses.
- Any damages resulting from your reliance on umay's predictions or insights.
Where liability cannot be excluded, our total liability for any claim arising from or related to umay will not exceed the total subscription fees you paid us (if any) in the 12 months before the claim.
12. Indemnification
You agree to indemnify and hold harmless Arda Kaan Özcan from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of umay or violation of these Terms, to the extent permitted by applicable law.
13. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes via the app or by other reasonable means. The “Last updated” date at the top will reflect the change. Continued use of umay after changes take effect constitutes acceptance of the new Terms.
14. Governing law and disputes
- These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-laws rules.
- If a dispute arises, please contact us first at hey@ardakaanozcan.com so we can try to resolve it informally.
- If we cannot resolve the dispute, and you qualify as a consumer under Turkish law, you may apply to the Tüketici Hakem Heyeti (Consumer Arbitration Committee) within the monetary thresholds set by Turkish law, or to the Tüketici Mahkemesi (Consumer Court). Consumers in Turkey may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr for disputes with EU-based companies; this is not applicable to disputes with a Turkey-based developer.
- Nothing in this section limits any mandatory rights you have under Turkish consumer law or KVKK.
